JaziNET Acceptable Use Policy
You are Bound by This Policy
Use of the Internet Services provided by JaziNET (“the Services”) is subject to this policy.
By completing and signing the JaziNET Internet Application Form, you undertake to observe and abide by the AUP. In other words, our acceptance of your application is conditional upon your agreeing to abide by this policy.
Further, you are responsible for ensuring that anybody else who uses your Account and the Services does so in accordance with this policy. If that person breaches the AUP, JaziNET reserves the right to terminate or suspend your Account or take any other action against you under this policy.
Purpose of the AUP
The purpose of this policy is to ensure that you use the Services in a manner which:-
is in accordance with the law;
does not disrupt JaziNET's ability to provide the Services to our customers; and
is fair to JaziNET customers and others using the Internet.
The AUP is Subject to Change At Any
JaziNET may change this policy at any time. Whilst we will post notice of any changes on our site it is your responsibility to read the AUP from time to time to ensure that you are aware of any changes and your obligations under this policy.
Any changes to the AUP become effective as soon as they are posted on our website.
You should be aware that Western Australian and Commonwealth laws prohibit the viewing, transmission, distribution or storage of certain types of material via the Internet. You should visit www.waia.asn.au for more information on this issue.
You must not use the Services to:
post, transmit, distribute, store or otherwise deal with any information or material which is in breach of any law, code or standard. Such information or material may include obscene, violent, racist or pornographic material, credit card or other financial information, or material protected by copyright or patent.
infringe, or attempt to infringe, another person's intellectual property rights;
conduct or promote illegal activities;
obtain, or attempt to obtain, unauthorised access to any computer, system, network or website.
damage, or attempt to damage, data stored on any computer, system or network.
alter, or attempt to alter, data stored on any computer, system or network without proper authority.
breach, or attempt to breach, any security or authentication measures on any computer, system, network or website.
interfere, or attempt to interfere, with the provision of Internet services to any user, host or network; or
use, or attempt to use, the username or password of another JaziNET Customer or Internet user.
Improper Use Giving Potentially Giving
Rise to Civil Liability
You must not use the Services for any purpose which may give rise to civil proceedings being commenced against you including, but not limited to:
posting, transmitting, distributing or storing any information or material which:-
is obscene, abusive or offensive;
harasses, threatens or menaces any person or entity;
otherwise infringes or restricts the rights of any person or entity or that person or entity's ability to use the Services or the Internet; or
is otherwise an abuse of privacy.
damaging data stored on any computer, system or network;
using the username or password of another JaziNET Customer or Internet user without proper authorisation;
disclosing another person's private or confidential information without that person's consent;
using a person or entity's credit card details or financial information without proper authorisation; or
interfering, or attempting to interfere, with the provision of Internet services to any user, host or network.
Other Improper Use
You must not use the Services in a manner which interferes with the ability of other JaziNET customers or Internet users to use and enjoy the Internet. In particular, you must not:
use the Service in any manner so as to occasion a breach of the WAIA Spam Code of Conduct (http://www.waia.asn.au/info/spamcode.shtml). For the avoidance of doubt, to the extent of any inconsistency between the WAIA Spam Code of Conduct & this policy the WAIA Spam Code of Conduct prevails.
monitor data or traffic on any network or system without proper authorisation;
send unsolicited email or post irrelevant material to newsgroups, whether through JaziNET's mail or news servers or through other servers which you access using the Services.
provide false information to JaziNET or other Internet users;
disobey the rules of any newsgroup, forum, email mailing list or other similar
cross-post (post the same material to a large number of newsgroups);
use the Services in such a way as to interfere with the operation of the Services or any computer, system or network;
use the Services in a manner which JaziNET considers to be excessive, unusual or inconsistent with the purpose for which the Product which you have purchased is intended including but not limited to:
for a non-permanent dial-up internet access Product, remaining on line on average greater than 12 hours per day during any period of 30 consecutive days; or
for a dial-up internet access Product, downloading more than 10 gigabytes during any period of 30 consecutive days.
Material on the Internet
The Internet contains information and material that is unsuitable for children and , in some cases, unlawful for children or adults to view, transmit, distribute or store. You must adequately supervise access to your Account and the use of the Services by minors.
JaziNET takes no responsibility for materials or content viewed or downloaded by other people, including minors, by accessing your account and using the Services.
Similarly, JaziNET has no control over, and takes no responsibility for, the availability and content of information and material on the Internet.
JaziNET's Response to a Breach of the AUP
JaziNET will co-operate with JaziNET customers and other Internet users to ensure compliance with this and other acceptable use policies.
JaziNET will assist the Police and government agencies with any enquiries into the use of the Services for an illegal purpose.
If you breach this policy, JaziNET may take any action it deems appropriate including, but not limited to:
the implementation of measures to prevent similar breaches of the AUP in the future;
the termination of your account: see our General Terms and Conditions;
the suspension of your account until further notice: see our General Terms and Conditions.
the commencement of legal proceedings to recover any loss or expenses suffered by JaziNET as a result of your breach of this policy.
Ensure that Anyone Who Uses Your
Account is Aware of This Policy
You must ensure that anybody who uses your Account:
is aware of the AUP, JaziNET's General Terms and Conditions and any Specific Terms and Conditions which apply to your use of the Services; and
complies with the AUP and those terms and conditions.

Familiarise yourself with JaziNET's General Terms and Conditions and any Specific Terms and Conditions which apply. They also govern your use of the Services.
The Terms and Conditions are posted on this site and may be updated occasionally. Again, whilst we will post notice of any changes it is your responsibility to read our Terms and Conditions from time to time to ensure that you are aware of any changes and your obligations.
